This payment can also be made in the form of awards, prizes, services, rents and other miscellaneous income payments within a specific tax year. The 1099 forms are generally issued to all unincorporated and individual businesses like limited liability companies, estates, limited partnerships and partnerships. Thus, if you are a businessman and if you have paid $600 or more to an independent contractorduring a particular tax year, you will have to make arrangements for form 1099-MISC. this will help you in telling the IRS about the amount you paid to the independent contractor. However, there are some exceptions to this particular rule.

1099s Do Not Need to be Filed for Corporations

One of the most general and the most important rules that need to be kept in mind while filing 1099s is that these forms do not need to be sent to corporations. In case a company or an individual that a business hires is identified as a corporation, the business does not need to take the tension of filing form 1099. Though it is very rare, independent contractors might sometimes operate in the form of incorporated businesses. In case, businesses work with incorporated independent contractors, they do not need to submit form 1099.

Do not Forget to Check Your Mail

There are a lot of people who take care about the W-2 forms because they are attached to their tax returns highlighting wages and the taxes withheld. However, people tend to be very careless about form 1099. This is something that needs to be avoided. Each 1099 form should be watched out for. This is because these forms are matched to the Social Security Number of an individual and an individual is guaranteed an audit if he or she fails to report these forms.

Do Not Forget About Address Changes

In spite of the fact that the issuer of the form possesses an individual’s old address, information gets delivered to the IRS depending on the Social Security Number of an individual. Therefore, it is important for people to make sure that their correct addresses have been provided so that they can receive a copy of these forms easily and conveniently. Address changes need to be updated directly with the payers along with putting a forward order with the US Post Office. It is important for you to see every form that the IRS sees.

Beware of Errors

Deadline for filing federal 1099 form is 31st January each year. The payer; however, has time till the end of February to send the copies of the form to the IRS. There are many payers who send the forms to the taxpayers and even to the IRS simultaneously. However, there are others who make use of a delay of 30 days. This delay actually means that the tax payer has got chances of correcting certain errors in the form. It is necessary for the tax payers to go through the forms immediately instead of just piling them up.

Do Not Lose the Forms

As soon as the form is received, it needs to be opened and checked. The forms need to be kept in a safe place because they might be required while doing tax returns. Some individual take the services of a tax preparer and in this case they need to provide copies of each form that they receive to the tax return preparers. This is how to file form 1099.

Important Things to Know About IRS Form 1099 Prior to Filing Taxes

Taxpayers are not very fond of receiving IRS Form 1099. On the other hand businesses might also not like sending these forms out. In fact, it can rightly be said that there is not a single individual who likes Form 1099 with IRS being an exception. The IRS or Internal Revenue Service simply loves the 1099s because these forms make way for data matching against the tax returns. Some of the most important things that you should know in regard to Form 1099 prior to filing your taxes are as follows:

It is better to give the Form rather than Receiving it

Usually, businesses bear the responsibility of issuing the 1099s to payees receiving minimum $600 during a year. However, this is just a basic rule and there are several exceptions to this rule. This is the reason why individuals get form 1099 for almost every bank account that they might be maintaining. This goes even for the people who earn not more than $10 of interest income.

Many Varieties are Available

There are different varieties available in the category of IRS Form 1099. There is 1099-DIV for dividends, form 1099-INT for interest, form 1099-R for payouts from individual retirement accounts and pensions, form 1099-G for unemployment benefits and local and state tax refunds, form 1099-S for real estate transactions and form 1099-B for barter exchanges and broker transactions. In fact, it would be right to say that there is a dizzying assortment available. You might come across different categories. However, remember that Form 1099-MISC standing for Miscellaneous is quite prompt. It covers a huge territory and the largest number of questions are also included in this type of form 1099.

Timing is Important

It is important for businesses to send out the IRS Form 1099 to their employees by 31st January against the previous calendar year. Nevertheless, if you do not receive form 1099, you must not assume that you do not have the responsibility of reporting your income. You must report your income even if you do not receive form 1099 by February or March. Companies should remain aware of the fact that they would have to pay penalties if they issue the 1099s late.

Beware of Changed Addresses

Change of address information will genuinely be reported to the IRS depending on the Social Security Number of an individual despite the fact that you receive form1099 or not. It is your duty to update your changed address with the payers directly. You also need to carry out the responsibility of placing a kind of forwarding order with US Post Office.

IRS also Receives Form 1099

You might be well aware of the fact that any form 1099 that you receive is also sent to the IRS. Deadline for mailing the forms to taxpayers is 31st January. However, the tax payers have time till March to submit all the completed 1099s to the Internal Revenue Service.

Willful Filing as Late For Income Tax Returns Even After Filing of Form 4868 and Beyond Attracts Penalty

Now we can see that how a failure of timely file of individual income tax returns on time even beyond the extended time of request through IRS form 4868 may result in a penalty called “Failure to Timely File Penalty” which come through section 27 of Code of Federal regulations (CFR) 24.274-Failure to timely pay tax or file a return.

By this CFR in force, the penalties for failure to pay tax at the time required, for willful refusal to pay the tax as per section 27 and for fraudulent nonpayment of tax are provided for in 26 U.S.C. 5661 and 6656. In addition to these penalties, there is a penalty for the delinquent filing of a tax return, imposed as an addition to the tax shown on the return, amounting to five percent for each month or fraction thereof of the minor crime or neglect of one’s duty, not exceeding 25 percent in the aggregate, unless it is shown that the neglect of one’s duty is due to reasonable cause and not to willful neglect.

Src: Flickr
However in the case of individual or as common income tax filers, the fraudulent non-payment may not occur as presumed unless or otherwise those involved in spirits trade like wine, where-in this section 26 U.S.C. 5661 and 6656 as stated as whoever, with intent to defraud the United States, fails to pay any tax imposed upon wine or violates, or fails to comply with, any provision of subchapters of USA laws, or regulations issued pursuant thereto, or recovers or attempts to recover any spirits from wine, shall be fined not more than $5,000, or imprisoned not more than 5 years, or both, for each such offense, and all products and materials used in any such violation shall be forfeited to the United States.

This also includes other offenses as punishable and the law states-Any proprietor of premises subject to the provisions of subchapter of US law, or any employee or agent of such proprietor, or any other person, who otherwise than with intent to defraud the United States violates or fails to comply with any provision of subchapter or subpart of part I of subchapter A of US law, or regulations issued pursuant thereto, or who aids or abets in any such violation, shall be fined not more than $1,000, or imprisoned not more than 1 year, or both, for each such offense.

Here one should not get misconstrued about the subject as present in this blog but it is always about that whoever as an individual who need to submit the income tax returns to IRS within the prescribed time as April 15th of 2015 should be dutiful. Whatever tax as figured by such individuals if could not be paid can be deferred through request of IRS form 4868 and this may only extend time for payment and not time to pay tax as one have to pay truly to IRS.IRS will include interest payment along with figured tax dues. But when one tries to postpone the tax payments with interest even beyond the extension time of 6 months as given by IRS form 4868 then may violating the IRS law to call for undue penalty should be understood.

Fail to Pay Tax on Time Only Hail Penalty from IRS

In this section, the civil penalties like when one does not file the tax but having paid the taxes by due date will also attract a penalty. In case if a person substantially understate his or her tax, or file an irresponsible tax return like frivolous return, or failing to provide the SSN-Social Security Number will also suffer by the penalties of IRS. The civil fraud penalty will apply and payable by persons who provide dishonest or unlawful information.

The failure-to-file penalty may be applied to persons when they do not file tax return by due date including and even after utilizing the credit period through extension forms, this penalty amount is calculated at 5% for each month or part of a month based on the delay or lapse period of tax return  however treated as late. The maximum penalty chargeable by IRS is not more than 25%.
When a person is found that the failure to file tax returns is due to his fraud or being unethical, the penalty will be charged as 15% for each month or part of a month based on the lapse period of tax return but however treated as late and the maximum penalty chargeable by IRS may be 75%.

When the tax return was delayed by more than 60 days even after the due date or including the extended due date as per extension forms, the IRS minimum penalty will be smaller of $100 or 100% of the unpaid tax. If the reasonable cause is justifiable to IRS that that the filing and paying delay of tax was due to genuine reasons and not because of will full neglect, then one is forgiven and do not have to pay the penalty.

Src: Flickr
One has to pay the failure-to-pay penalty of 1/2 of 1% of one’s unpaid tax for each month, or part of a month, after the due date that the tax is not paid. This penalty does not apply during the extension period available by filing Form 4868, Application for Automatic Extension of Time To File U.S. Individual Income Tax Return, if one has paid at least 90% of his/her actual tax liability before the original due date of your return through withholding on wages, estimated tax payments, or a payment sent in with IRS Form 4868. If a notice of intent to levy is issued, the rate will increase to 1% at the start of the first month beginning at least 10 days after the day that the notice is issued.

If a notice and demand for immediate payment is issued, the rate will increase to 1% at the start of the first month beginning after the day that the notice and demand is issued. This penalty cannot be more than 25% of his/her unpaid tax. One will not have to pay the penalty if they can show that he/she had a good reason for not paying their tax on time. This failure-to-pay penalty is added to interest charges on late payments.

The Combined penalties are that if both the failure-to-file penalty and the failure-to-pay penalty apply in any month, the 5% (or 15%) failure-to-file penalty is reduced by the failure-to-pay penalty. However, if  a person file his/her tax return as delayed for more than 60 days after the due date or extended due date, the minimum penalty is the smaller of $100 or 100% of the unpaid tax.

IRS wants to be just and even so as to be reasonable to taxpayers despite their various shortcomings as shown in these chapters and so it is always better to avoid the penalties than overcoming it. Independent Contractors Are Always Dependent on Form 1099-Misc as Put Up As IRS Ways

IRS is here in the USA to do the rightful, purposeful, and dutiful job of tax collections for different IRS forms and one such form is 1099-MISC structured for reporting tax return for miscellaneous income and which has been normally received by millions of people across the US who are as self-employed, as independent contractors, entrepreneurs, and self-styled practitioners. This continues day after day for which IRS structured this form 1099-MISC exclusively for people who do services as consultants under part-time, unlike the employees who work in full-time to file w-2 forms.

It is obvious that IRS ensures that people pay taxes both direct and indirect means and collects the taxes owed.IRS do this by co-ordination as matching the 1099-MISC form as they received from your client with the one you have received. It is something like a background information that IRS has a proof from your client that you have already received payments from him for the services and hence it is unavoidable that you owe tax to IRS through form 1099-MISC. Especially with IRS form 1009-MISC the independent contractors and consultants as service providers have to be careful and it is like a blade with two sharp edges and inescapable.

IMG Src: Flickr
As an independent contractor, consultant, entrepreneur, everyone will get a 1099-MISC form from the companies they provided necessary and required services for - as long as the payments were at least $600 for the prior year. Now, if they did not get anything in the mail, then they should contact their respective clients and request for the form 1099-MISC. Yes, there can be times when the form can get lost or sent to the wrong address or, the clients may have taken up their own time which becomes been late or did not even realize a form needed to be sent out! To help along with the process, as independent contractors, consultants, one should also send over a completed W-9 form.

And further what if the client still does not send the 1099-MISC forms? Well, Independent contractors still need to report the income and also simultaneously notify the IRS. Often there are enough chances in accounting of your bills being overlooked, Independent contractor should report any gross income earned even if it’s under the $600 threshold.

When an Independent contractor starts to receive the 1099-MISC forms, he can start the process of putting all bills and figures together to work for your tax return. It is needed for many independent contractors to fill-out a Schedule C to tally up the income earned and if any deductible expenses. There will also be a need to file a Schedule SE, which accounts for Social Security and Medicare payments.

Independent contractors can have the experience of perfect tax preparation software as provided by IRS certified tax partner http://www.Etax1099.com for e-fling needs of IRS form 1099-MISC.

Different Tax Form 1099 Demands Reporting Of Different Types Of Income

As the tax season is fast approaching, the tax form 1099 will also be in reckoning for the taxpayers to take into account. There are different forms of 1099 as structured by IRS to demand reporting different types of their income.IRS distinguish the different types of income by employing this tax form 1099 to ascertain the one’s income is from the regular job or through other sources. Hence this form 1099 assumes greater significance and thus it has a different sourced heading as 1099-INT, 1099-C.1099-S, 1099-MISC, and even transactions between federal and state holdings. Interest received from banks from deposits made are issued with 1099-INT.

If one fails to repay loans to banks and institutions and then being sanctioned forgiveness for write-off the loan is always considered as an income then the failed candidate is issued with 1099-C. The Income proceeds from real estate transactions attract 1099-S.

A regular job has always fetch you a w-2 issued from your employer and when one does not get it then the tax form 1099 will be issued to you by the payer responsible for utilizing your services and that the amount value should be over $600.

Src: Flickr
Once the service bill over $600 attracts IRS tax form 1099 from service provider then one must keep up it with the tax records for matching it to entries made in the tax form. One has to report or show IRS the correct and exact receival of payments for the services made even when they do not receive tax form 1099 and as not exactly with the correct amount paid from service provider.

This is only to help one’s cause to overcome unnecessary hardships in terms of IRS intervening in the process and penalizing. The payer or service provider who offers you a service should send a copy of the form 1099 to IRS and so it makes easy for IRS to track you in case if you could not provide one and also try to hide the service amount as received.

When Are 1099 Forms Due and What are the Late Filing Penalties?

A form 1099 is an information return and is a tax form that you get in the mail if you have received certain types of income during the previous tax year. The information your receive will have to be placed on your tax return. A 1099 is very similar to a W-2 but where a W-2 reports any wages, salaries, and tips earned, a 1099 reports all the other kinds of income you may receive as well. There are many different types of 1099 forms and each one is used to report different types of income.

When Should I File my 1099 IRS Form?

The deadline for employers to mail out W-2s and send form 1099 statements to their employees and for their business is January 31. The deadline for financial institutions to mail out their 1099 forms is February 18. The deadline for businesses to mail their 1099 forms in is February 28 if doing it by paper and April 1 if doing it electronically. In order to file your forms electronically you will need to have a specific software that will generate a file that you can use to submit everything you need online.

What are the Penalties for Filing Late?

If you fail to file your 1099 electronically on time then you may be subject to a penalty per return unless you can provide a good reason why you missed the deadline.

You can also receive penalties for:

·         Failing to include all the information that is required
·         Filing your 1099 with false information
·         Filing your form on paper when you should be filing it electronically
·         Reporting an incorrect tax identification number (TIN)
·         Not reporting your TIN
·         Filing paper forms that are not readable by the machine

The amount of the penalty is based on the time you file your forms with all the correct information. The penalty is typically:

·         $15 per information return if you file the correct information within 30 days of the due date. For small businesses the maximum penalty is $25,000 and for individuals it’s $75,000.

·         $30 per information return if you file the correct information more than 30 days after the due date but by August 1 of that year. For small businesses the maximum penalty is $50,000 and for individuals it’s $150,000.

·         $50 per information return if you file after August 1 or you do not file the required information on your returns. For small businesses the maximum penalty is $100,000 and for individuals it’s $250,000.

One of the easiest and most efficient ways to prepare your tax return is by filing your forms online with an online tax software. You don’t have to worry about figuring out how to file form or where you need to put what number because the software will guide you through the entire process telling you where to find what information and what each box means in regards to your taxes. So when getting ready to file your federal 1099 form online make sure you have all the correct information and you meet the deadline for filing.

Like IRS Tax Strictures Towards Form 2290 For Truckers, FMCSA Form Safety Compliance Structures

Truckers should e-file form 2290 tax returns this tax season before or on the specific due dates and it is the federal order from IRS and similarly the CSA-Compliance Safety Accountability program as introduced by Federal Motor Carrier Safety Administration (FMCSA) four years ago is equally to be adhered by the drivers of commercial heavy motor vehicles and fleet-owners of transporting industry as a whole.

But FMCSA findings through Commercial Vehicle Safety Alliance show that there is a low awareness rate among the drivers about the following of the basic rules. Hence the drive through road check by CVSA law enforcement officials normally helped in increasing the awareness rate year after year as the in-person checking of commercial motor vehicles and conversations with drivers brings in a good inter-action for imparting the basic guidelines for safety not only for drivers but also for all the users of national highways to prevent any untoward accidents.

The accident death rates have been lowered due to this stringent exercise by CVSA in association with FMCSA in pursuing the CSA basic instructions.

Src: Flickr
The CSA instructions stress on safe driving for drivers to be responsible without rash and reckless unsafe driving. The drivers should follow HOS-hours of service through electronic logging devices (hours of service guidelines are given to truckers for necessary action), as this only helps them to overcome fatigue and illness while driving on duty on the highways.

The CSA instructions to drivers are to be followed-up strictly, also equally is the adherence to the instructions given to commercial motor vehicle with regard to overcome OOS-out of service violations due to CVSA inspectors considering imminent safety hazard. The often sore parts of commercial heavy vehicle are the brakes and tires which should be maintained and conditioned and CVSA through FMCSA advise truckers and fleet-owners to use the best manufacturers’ brands in order to be complaint with the Compliance Safety Accountability-CSA.

Now truckers while adhering to Compliance Safety Accountability for their sustained transporting business should also e-file form 2290 tax returns by 1st July 2014 through IRS tax partner and certified service provider Etaxform2290.com

Operation safe Driver Program Always Needs Co-operation From Truckers and Drivers

Commercial Vehicle Safety Alliance - CVSA has laid out various safety programs for commercial vehicle drivers and fleets, teens and trucks and the program is basically formulated to avert untoward accidents on national highways of North America.  The estimates from CVSA show that 40,000 people die because of serious accidents happening primarily due to unsafe driving practices by both passenger and commercial heavy vehicle drivers. Hence this Operation Safe Driver program is aimed at to reduce the number of deaths resulting from crashes involving large trucks, buses and passenger vehicles.

Operation Safe Driver program is very active by holding activities across the United States, Canada and Mexico that aim to increase and implement commercial vehicle and non-commercial vehicle traffic enforcement; safety belt enforcement; driver roadside inspections; driver regulatory compliance; implementation of commercial driver educational and awareness programs to the motor carrier population; and, awareness to the motoring public about safe operations around commercial motor vehicles.

According to CVSA sources “There are 9.4 million kids between the ages of 16-24 driving on the highways. They make up only 4.7% of the total number of licensed drivers, but are involved in 10.1% of fatal accidents and in 13.5% of all accidents”.

For the right of passage on the national highways the driver’s license is compulsory as many teens know and wait anxiously to apply and to get a driver license. They would feel this as a great sense of freedom as being young and first timers with a freaky adventurous upbeat mood that will make them to drive with friends, speeding, aggressive and other distracted driving behaviors and one can see how this rite of passage puts teens on a one-way road to increased risk.

Therefore in order to protect the safety interest of the teens that drive around the large commercial heavy vehicles on the highways, CVSA has partnered with Arizona Trucking Association and with American Trucking Associations and developed a program to help educate teens about safe driving practices around commercial vehicles.

For commercial heavy vehicle drivers and fleets that always run on the national highways, the CVSA is keen on certain safety program on avoidance of various in-truck distractions that cell phones, CD players, eating and other activities that may pose direct or indirect problem to avert drivers’ constant attention of the roads. Hence it is important for CVSA for using tools like Defeating Distracted Driving to raise awareness of this significant safety problem.

More than the CVSA guiding safety awareness programs including Operation Safe Driver, the trucking and fleet-owner community must respond positively through better co-operation in order to pave way for a smooth and safe journey on national highways. Equally it is also important to respond to IRS for e-filing your tax return form 2290 for this tax season 2014- 2015 through IRS tax partner and service provider http://www.Etax2290.com

IRS Form 7004 Busincess Tax Extension Form - Privilege Or Purpose?

It is indeed a strange coincidence that all IRS forms need to be filed on or before due dates, but then why the existence of the support and importance of forms like IRS form 7004 give-in the privilege for the automatic extension of time? In business, in times when it is good we follow the strictures and rules and when in unfavorable conditions we deviate the rules.

These shows the ups and downs of business which then fails to submit to the rules and it is for this reason IRS laws are structured to give an extended arm of support with the form 7004 for those failing. However one should understand that this is no privilege but with a purpose. The privilege is the automatic extension of time through IRS form 7004 to file income tax returns of business and the purpose is to make them pay the tax by form 7004 online facilitating them with automatic extension of time with some interest and penalty.

This would exhibit as just like a loan that an individual and business may avail at a certain cost of interest from Government as they do with banks or outside source, but there they have to pledge something as security. Here we as individual and businesses of many categories stand as a security and pledge for the nation’s good cause.

This is to be understood in contrast since taxpaying based on income brings in integrity to self and this would give scope for recognition and opening up of new avenues to bring in financial strength that banks and other people can participate as shareholders to further develop a conducive atmosphere towards a good economy that IRS propagate by the importance of tax paying and also gives give some extended time for tax collections with some reasonable interest and penalty so that nation may prosper through economic and infrastructure developments which would only benefit the citizens.

Not every individual who earn big money can take-away all to his needs for comfort living, this is where the Govt.through IRS has spread the wings to bring in lot of tax money that would feed society, community, and a country which goes to prove that sharing resources would make a country good and big for the welfare development of their population.

Benefits of Online Filing for Tax 2290

With many websites online offering aid, it has never been easier to file the tax form 2290 to the IRS. This tax form is for heavy highway vehicle use. It is a tax return form in which the due date revolves around the fiscal year starting on July 1st and ending on June 30th. There are of course some exceptions to this, depending on many factors. Those that must pay the tax and turn in the form are owners of these heavy vehicles that are over 55,000 pounds. They are used on the public highway regularly to transport anything, and the amount that is taxed varies among the different weights and maximum loads on different trucks.

Times to File the Form

The qualified vehicles that are taxed include trucks, tractor trailers, buses, or truck tractors. Should any of these heavy vehicles exceed the 5,000 mileage usage limit on solely public highways, then the IRS form 2290 tax is due before the end of the fiscal year. It does not matter if there is a new owner of the vehicle; any particular vehicle has its own timing on the mileage whether or not it has multiple owners. The right time to file the 2290 tax online or on paper is for the month that the vehicle is first being used on public highways. The last day to file is the last day of that month. There are penalties and interest should the form not be filed on time that vary depending on how late the form is received.

Online Filing and Physical Filing

It is important to avoid penalty fees and any interest, especially when it comes to tax forms. They can appear to be daunting, but rest assured that there are tax professionals online providing software to make it easier for everyone. Filing the IRS form 2290 can be done physically through printing the form and mailing it in, or by filing it electronically through the IRS.gov website. By filing it online, you can get help from sites like ETAX2290. It is generally a safer, quicker, and less painful process. They can help you get through the form accurately and in on time. By submitting it online, they are also able to keep your records through your ETAX2290 account for as long as you need. Mailing the form is less secure and you are most likely going to be unable to keep an organized record of your files. Whether you have multiple taxable heavy vehicles or just one, through online filing you can put it all under one account.

When searching for aid in filing the 2290 tax online, the prices will vary depending on the amount of vehicles you own. Should you own over 25 taxable vehicles, you must file online regardless. For an example of prices, one vehicle would cost $19.99 through ETAX2290. Their prices are very reasonable and can aid you in preventing from incorrectly filing the IRS form 2290 and getting any penalties.
